In 2019 the Government committed to repeal and replacement of the 1992 Mental Health Act. This followed submissions to the 2018 He Ara Oranga Inquiry. After a period of public submissions, Manatū Hauora convened an Expert Advisory Group to advise on new legislation, which is currently in the drafting process.


The key issues for College members are:


  • Recognition within the legislation of a Te Ao Māori world view,
  • Assessment and decision making within the new legislation,
  • The likely introduction of a capacity based standard,
  • Recognition of advance directives,
  • Supported decision making.
